‘The landlord is obliged to carry out all necessary repairs to maintain the dwelling in habitable conditions, except when the deterioration is attributable to the tenant’.
This means that, if the air conditioning in a rented flat stops working due to normal use or technical breakdown not caused by the tenant, the responsibility for the repair falls on the property. In that case, the tenant is obliged to report the problem and allow access for repair.
However, if the damage is caused by misuse or negligence on the part of the tenant, the tenant must bear the cost.
